Terms of use

This translation is provided for convenience; the German version is legally binding.
1. Who provides this service
These terms apply to the use of Nighthopper. They do not govern your trip — the terms of the provider you book with apply to that.
2. What we provide
Nighthopper searches for prices for flights and accommodation, shows them side by side and takes you to providers you can book with. In addition, there are prices and tips for car hire, transfers, eSIM and lounges. On the “Flights” page, the search and results come from a search module of our partner network Travelpayouts; there too, you book with the provider concerned. On the “Package holidays” page, destinations, hotels, dates and prices come from CHECK24 (TARIFCHECK24 GmbH, CHECK24 partner programme); you book with CHECK24.
We are an intermediary: not a tour operator, not a travel agency, not an airline. We do not accept money from you and do not issue tickets.
3. How a contract is concluded
A contract is concluded exclusively between you and the provider you select on its site. That provider’s prices, fare conditions, baggage rules, cancellation and rebooking conditions apply. You direct any claims arising from a booking to that provider.
4. No package holiday, no linked travel arrangements
Our pages show several types of travel service side by side — flights, accommodation, car hire, transfers, eSIM. We do not put together a package from them: there is no total price, no joint booking process and no contract with us. You choose and pay for each service with the provider concerned, and each has its own contract.
This means that no package holiday comes about. The rights that the EU Package Travel Directive (Directive (EU) 2015/2302) provides for package holidays do not apply to these services. The provider concerned is solely responsible for providing the service properly; if there are problems, please contact that provider.
We do not accept payments for travel services and do not pass your name, payment details or email address on to providers. Switching to a provider’s site is a referral, not a booking: what you enter there, you enter there.
Exception: the “Package holidays” page. What you book with CHECK24 from there is a genuine package holiday: the tour operator concerned puts the package together and is your contracting party, CHECK24 brokers the trip, and you have all the rights under package travel law against the tour operator. We only display its offers. We are not party to this contract — we do not put the trip together, do not see your booking details and do not accept money. You direct any claims arising from the trip to the tour operator or to CHECK24.
5. Prices and availability
All prices come from third parties. Each result or the section concerned shows which source the price comes from and when it was retrieved. Prices and availability change constantly; the price at the provider may differ. The price the provider displays when you conclude the contract always applies.
Where a source does not provide reliable information, we say so explicitly instead of filling the gaps.
6. Commissions
If a booking, another transaction or a confirmed enquiry (a so-called lead) comes about through our referrals, we receive a commission from the partner concerned. Some partners pay just for the click through to them. What exactly is paid for is set by the partner’s programme. With the provider, you pay the same price through us as you would directly. Such placements are labelled as ads. In the hotel offer comparison, we only show offers from our partners; other providers, including the hotel’s own website, do not appear there. How we order results is explained under How we sort results.
7. Account, My trip and packing list
You can search, compare and switch to a provider without an account. “My trip” and the packing list are only available with an account.
How the account is created: You enter your email address on “My trip”, the packing list, the price alert or the deal email and choose “Send code”. With the correct code from our email, a free user agreement for your account is concluded. You can correct a mistyped address before sending or with “Different address”. We do not store a separate contract text; these terms are available here at any time and can be printed or saved. The contract language is German. The account is for people aged 18 and over.
What it does: Flights and car hire that you open with a provider through us are saved in your account automatically — with a countdown, booking status and the notifications from our partner networks — and shown on every device on which you are signed in. Anything you save yourself without signing in waits in your browser and moves to your account once you sign in. An account holds up to 50 trips; when it is full, past entries and old entries that were not booked make way first. We delete past trips at the end of the third year after the trip. The account is not a booking account: you always conclude contracts for trips with the provider concerned.
This includes the packing list: a checklist for beach, city or snow, with or without a hire car, stored in your account and the same on every device. You pack a separate list for each trip in your account; if we can tell the destination country from the destination, what is particularly important there appears at the very top. Without a trip, a general list applies. The items are general tips; the current rules on entry and health are published by the German Federal Foreign Office, which the list refers to at these points.
This includes the price alert: you set up to ten flight routes, we check the cheapest most recently found price once a day and email you when it has fallen. The prices are not real-time prices and not an offer from us; what the provider shows when you book applies. There is no entitlement to a notification or to a particular price. If you wish, you can also order the deal email (once a week, only with your consent, unsubscribe at any time).
How it ends: You can delete the account at any time in “My trip”; it is then gone immediately with all trips and packing lists. We can terminate the account with four weeks’ notice, or immediately in the event of misuse — such as automated requests or signing in with other people’s addresses. What we store and for how long is set out in the privacy policy.
8. Use of the site
The site may be used for personal travel planning. Automated extraction of content, reproducing the results in other services and actions that disrupt operation are not permitted.
9. Liability
We are liable for our own content in accordance with the statutory provisions. We are not liable for the offers, prices and services of the linked providers; we are not party to their travel and carriage contracts.
We strive to keep the site available at all times, but do not guarantee it: the search depends on third-party sources, which may fail or change their information.
10. Changes
We may change these terms if our service or the legal situation changes. For mere use of the site, the version published at the time of your visit applies; the date is shown at the top.
If you have an account, we will announce a change by email at least four weeks in advance and tell you what is changing. If you do not agree, you can object until the change takes effect; your account then ends at that point and we delete it together with its content. You can download your data beforehand in “My trip”. Changes that impose new obligations on you or significantly restrict the service of “My trip” only apply if you agree to them.
11. Applicable law
Georgian law applies. If you are habitually resident in the European Union, the mandatory consumer protection provisions of your country of residence remain unaffected.
